1. Who we are and agreement
Nightcap ("the App") is an independent Android app developed and operated by Shreyansh Gaurav, a sole developer ("we", "us", or "the Developer"). By installing, enabling, or using the App, or by saving or running any cutoff, you confirm that you have read, understood, and agreed to these Terms of Use and to the Privacy Policy. If you do not agree, do not install or use the App.
2. What Nightcap does, and what it does not do
Nightcap schedules a real system power-off (reboot -p) of your device at a time you configure. It is the same orderly power-off you get from your phone's own power menu, carried out via Shizuku, a separate helper app you install and grant permission to. Nightcap does not perform the shutdown itself; it instructs Shizuku to do so on your behalf.
Nightcap cannot turn your device back on, recover anything that was lost when it powered off, or guarantee that a cutoff fires (that depends on your device, your OS, Shizuku, and your settings). It is a convenience tool for your own scheduling and self-control, and nothing more. It is not an emergency, safety, medical, security, or backup service, and must not be relied on as one.
3. Price, purchases, and refunds
The App is free to download and use. An optional one-time in-app purchase ("Pro") unlocks extra features such as repeating weekday cutoffs, unlimited cutoffs, and stricter modes. Pro is sold and processed entirely by Google Play, which acts as the merchant of record; we never receive or handle your payment details.
Refunds, cancellations, and your purchase history are handled by Google Play under Google Play's refund policy and the Google Play Terms of Service. Any statutory right of withdrawal you may have for digital purchases under your local law is unaffected.
4. Your responsibilities
- You decide when to schedule cutoffs. Nightcap will only fire at the times you configure.
- Before each cutoff, save your work and finish anything time-sensitive. Nightcap shows a heads-up and a live countdown with a Cancel button so you have the chance to do so.
- If you rely on the phone for alarms, calls, navigation, messages, two-factor codes, or any other function during the time a cutoff fires, plan around it or do not schedule a cutoff then.
- You are responsible for keeping Shizuku installed and running. If Shizuku is not running at the scheduled time, the cutoff cannot fire, and you should not assume that it will.
- The App provides a master kill-switch in Settings that disables all cutoffs at any time. Use it before any situation where an unexpected power-off could cause harm or loss.
- You are responsible for powering the device back on when you want to use it again.
5. Risks you accept when you use Nightcap
Powering a phone off has normal, foreseeable consequences. By using the App you understand and accept that, while or because your device is powered off by a cutoff you configured, any of the following may happen, and that they are the intended effect of the App working as designed:
- Unsaved work in any app is lost, and an app that is writing data at the moment of shutdown could lose or corrupt that in-progress data.
- In-progress downloads, uploads, backups, syncs, transfers, updates, or installations are interrupted and may need to be restarted.
- You will not receive calls, texts, emails, app notifications, reminders, calendar alerts, or two-factor / one-time passcodes, and you will not be reachable, until you power the device back on.
- Alarms, timers, and scheduled reminders will not ring while the device is off.
- You cannot make or receive emergency calls or messages, or share your location, while the device is off.
- Navigation, ride bookings, payments, banking or trading apps, tethering and hotspots, smart-home control, and any other time-sensitive activity are interrupted.
- Any watch, vehicle link, authenticator, or other device or service that depends on your phone being on may be affected.
This list is illustrative, not exhaustive. Other consequences of a device being off may also occur.
6. Assumption of risk and release
You acknowledge that the entire purpose of the App is to power your device off at times you choose, which by definition makes the device and everything on it temporarily unavailable. You choose if, when, how often, and in what mode to use the App, including whether to save an "Uninterruptible" cutoff that cannot be cancelled from the phone.
You voluntarily and knowingly assume all risk arising from a device being powered off by a cutoff you configured, including the consequences listed above. To the maximum extent permitted by applicable law, you release the Developer from responsibility for any such consequence, and you accept sole responsibility for deciding whether a scheduled power-off is appropriate for your circumstances at any given time.
7. Acceptable use
You agree not to:
- Use the App on a device you do not own or do not have permission to control.
- Use the App to power off or disrupt a device in order to harm, coerce, or interfere with another person, or in connection with any unlawful purpose.
- Distribute modified copies of the App, or reverse-engineer it, in violation of the licence under which it was distributed.
- Use the App in any way that violates applicable law in your jurisdiction.
8. No warranty
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE APP WILL FIRE A CUTOFF AT A PARTICULAR TIME OR AT ALL. We do not warrant that the App will be uninterrupted, error-free, free of data loss, compatible with every Android device, OEM, or version, or that any defect will be corrected.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY LOSS OF OR DAMAGE TO DATA, FILES, OR UNSAVED WORK, FOR ANY MISSED CALL, MESSAGE, ALARM, NOTIFICATION, REMINDER, OR PASSCODE, OR FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOST PROFITS, ARISING OUT OF OR RELATING TO THE APP OR TO YOUR DEVICE BEING POWERED OFF, WHETHER OR NOT THE DEVELOPER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE APP SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE APP, IF ANY, IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Because the App is free to download, that amount is zero for most users.
10. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless the Developer from any claim, demand, loss, liability, or expense (including reasonable legal fees) brought by you or any third party and arising out of your use of the App, the cutoffs you configure, your use of the App on a device you do not control, or your breach of these Terms or of any applicable law.
11. Your statutory rights
Nothing in these Terms excludes or limits any liability or right that cannot be excluded or limited under the law that applies to you. This includes your mandatory rights as a consumer and any liability for death or personal injury caused by negligence, for fraud, or for gross negligence or wilful misconduct. Where any disclaimer, release, or limitation above is broader than your local law allows, it applies only to the extent that law permits, and the rest of these Terms stays in effect.
12. Third-party components
Nightcap requires Shizuku to function. Shizuku is a separate application, governed by its own terms and privacy policy. Nightcap is not affiliated with Shizuku's authors, with RikkaApps, or with Google, and the Developer is not responsible for the behaviour, availability, or any change to Shizuku, Android, or your device's software.
13. Governing law and disputes
These Terms are governed by the laws of India, without regard to conflict-of-law rules, and the courts of India will have jurisdiction over any dispute. This does not deprive you of the protection of any mandatory consumer-protection law of the country where you live, or of any right to bring a claim there where local law gives you that right.
14. Changes to these terms
We may update these Terms from time to time. Material changes will be announced in the App's release notes (the "What's new" page). Your continued use of the App after a change takes effect constitutes acceptance.
15. Severability and entire agreement
If any provision of these Terms is held unenforceable, it is severed and the remaining provisions stay in full effect. These Terms, together with the Privacy Policy, are the entire agreement between you and the Developer regarding the App and replace any earlier understanding.
